Fay Seeking justice for victims and families affected by the october 7th attacks
On October 7, Hamas terrorists invaded Israel and carried out one of the deadliest attacks in the country’s history. The militants brutally murdered 1200 innocent civilians, injured thousands, and took more than 200 hostages. For nearly 30 years, Fay Law Group has been representing victims of terrorist attacks in lawsuits against foreign government and terrorist organizations, including Hamas. We are currently investigating the rights of the American victims and their family members to seek justice for these deaths and injuries using state and federal anti-terrorism and human rights laws.
Fay Law Group has collected more than $2 billion from Iran on behalf of victims of terrorism.
Fay Law group Can help
Fay Law Group is committed to seeking justice for American victims who were murdered, tortured, injured, and taken hostage by Hamas, and we urge those who have been affected to contact us. Spouses, children, parents and siblings of the victims may also be eligible to bring claims.
Fay Law Group has been at the cutting edge of anti-terrorism laws in Congress and in the Courts. We have represented hundreds of victims of international terrorist attacks as well as family members whose lives have been inalterably changed by their loved ones’ injuries. We have pursued claims against the governments of Iran, Sudan, Libya, and Saudi Arabia, as well as against terrorist organizations including Hamas, Palestinian Islamic Jihad, and the Taliban. Fay Law Group also pursues claims against banks and other financial institutions that aid and abet terrorist organizations. We have amassed more than $6 billion in judgments against state sponsors of terrorism and have recovered more than $2 billion for our clients. Our years of experience have equipped us to take on the intricate complexities of these cases, which often span continents and require an understanding of international laws and norms.
We have a proven track record of holding terrorist accountable for their malicious attacks. The foundation of our practice is the steadfast belief that obtaining and enforcing court judgements against terrorists allows us to cut off their lifeline - money - and prevent future attacks. It is also an opportunity for the victims to tell Hamas and its partners that these attacks have no place in society and will not be tolerated. Participating in these lawsuits can be a powerful and healing experience for the victims. Each case provides an opportunity to shape the future of this novel area of law so that we can continue to punish and deter terrorists and ensure that their victims are justly compensated.
How U.S. Laws Can Help
You may be able to use U.S. laws to hold Iran accountable for supporting Hamas in their attacks. Potential claimants include the estates of the deceased victims, as well as survivors who have sustained physical injuries and emotional distress. Family members of victims may also be able to bring claims for wrongful death and for their own emotional harm. Victims and families can use the law to hold state sponsors of terrorism liable for monetary damages. This gives you the option to legally identify Iran as responsible for the Hamas attacks and seek financial restitution.
The Terrorism Exception: 28 U.S. Code § 1605A
The Terrorism Exception of the U.S. Foreign Sovereign Immunities Act (28 U.S. Code § 1605A) is one key avenue for pursuing legal action. This law allows U.S. Nationals, Armed Forces members, and U.S. government employees or contractors to bring lawsuits against foreign states designated as sponsors of terrorism. Families of victims and survivors may also be eligible to file suits.
Under the law, a foreign state can be held accountable for personal injury or death caused by torture, hostage-taking, or by providing material support for such acts.
The United States Victims of State Sponsored Terrorism Fund (USVSST)
The USVSST compensates individuals who have judgments arising under the terrorism exception to the Foreign Sovereign Immunities Act, as discussed above. The fund was established to address challenges victims encountered in trying to enforce their judgments.
The Anti-Terrorism Act
Another avenue available to victims of the October 7 attacks is the Anti-Terrorism Act, which allows you to bring claims against foreign terrorist organizations, including Hamas and the individuals and entities that provided the resources they needed to plan and execute the October 7 attacks.
