Birth injuries lawsuit awards family $40M for negligent delivery

In a state not far from Washington, D.C., a lawsuit recently awarded over $40 million after just such a case of doctor error left a baby paralyzed.

The lawsuit was filed by the injured infant's parents. Before birth, the baby was in a position -- footling breech – which posed inherent risks, as the infant's feet would be delivered first. According to court documents, despite the known complications, the delivering doctor conducted the complicated procedure in an aggressive manner even though he reportedly lacked sufficient training or experience to do perform it at all.

He additionally failed to properly protect the infant's neck and head during the complex and risky delivery. As a direct result, the infant girl's spine was injured, and she became paralyzed from her mid-chest down. In fact, numerous experts and other doctors assessed the baby's brain scans and MRI and all concluded that her injuries were caused by significant trauma at birth during delivery.

Now, at age 6, the little girl is unable to walk or even stand on her own and attends therapy multiple times per week. A majority of the over $40 million in damages the jury awarded her family will go toward the costly medical treatments she is expected to need for the rest of her life.
