Hazardous conditions of roadway lead to lawsuit over broken foot

Often, premises liability lawsuits in Washington, D.C., and elsewhere revolve around slip-and-fall accidents in poorly maintained stores, restaurants or even parking lots, when puddles of water or other slick substances aren't promptly cleaned up, or when staff fails to remove dangerous objects from floors. But do other types of companies have the same legal responsibility to provide a safe environment for the public? Well, in another state, a pedestrian is suing over the hazardous conditions of the road after she suffered serious injuries as a result.

The woman has filed a lawsuit against a paving contractor after, she alleges, the company's negligence caused severe and lasting pain and bodily harm. The woman was crossing the last two lanes of a street when, the lawsuit claims, an unexpected drop in the pavement caused her to fall. This fall resulted in the woman breaking her left foot.

In addition to her pain, the woman now suffers from an impaired walking ability and physical handicap. She also has incurred significant medical expenses. The plaintiff requests a trial by jury with compensation sought in damages to exceed $15,000.

The lawsuit holds the paving company responsible for her accident, as it alleges the contractor failed to adequately maintain the premises and provide a safe and secure environment for members of the public. Additionally, the company failed to warn pedestrians of the hazardous conditions of the pavement. Any residents of Washington, D.C., who have also suffered serious injury due to negligently maintained premises are likely facing similarly high medical expenses as a result. In such situations, should victims wish to explore their options to fight for just compensation from the responsible parties, the ongoing support of an area premises liability attorney can prove crucial in securing a successful outcome.
