Woman files premises liability lawsuit after falling in hole

In a state not far from Washington, D.C., a woman has filed a lawsuit against several businesses after she suffered serious injuries. The premises liability claim accuses the defendants of negligence, carelessness and inattentiveness for their part in her July 2015 slip-and-fall accident. The woman claims that the injuries she suffered during the fall have severely affected her neck, ribs, legs, and right hand and arm.

The incident allegedly occurred when the woman was walking on the sidewalk at a shopping center and fell into a utility hole. As defendants, the lawsuit named Federal Realty Investment Trust (FRIT), Pet Valu Inc., Aqua America Inc., Budget Services Inc. and Energy Management Systems Inc. The plaintiff alleges that, as the defendants own property or operate businesses at the location, they are all responsible for the utility hole that resulted in her injuries.

The complaint alleges negligence on the part of the defendants because they allowed the hole to be dysfunctional for an unreasonable period of time. Furthermore, this alleged danger was present in an area where numerous pedestrians and customers walked in order to shop or enter stores there. For the physical injuries and more that the woman suffered as an alleged result of the defendants' carelessness and inattentiveness, she is seeking judgment in an amount less than $50,000, in addition to all court costs and interest.

Of course, as often happens, several of the defendants have already filed objections, asking for certain allegations to be stricken. They claim that certain criteria must be met and that some of the woman's complaints do not meet this standard, as the allegations are said to be conclusory in nature.
