A broken back during therapy leads to medical malpractice lawsuit

Generally speaking, the average individual has little to no medical knowledge. That's one reason patients in Washington, D.C., rely so heavily on the experience and wisdom of their health care providers; medical professionals go through years of school and training so that they can then use the skills and judgment they have developed to deliver a certain standard of care to their patients. When they fail to meet that standard and a patient suffers as a result, this negligence is considered medical malpractice.

In another state, for example, a woman suffered serious back injuries due to the alleged negligence of health care providers. The woman was receiving physical therapy when, the complaint alleges, a therapist told her to perform squats on a half-moon ball. The lawsuit alleges that, when the woman followed these instructions, she fell backwards onto the floor, suffering serious back injuries -- including fractured lumbar vertebrae -- as a result.

The woman's injuries, the complaint alleges, are a direct result of the defendant's failure to exercise a professional standard of care and treatment as a therapist. The lawsuit names as defendants RDV Sportplex, and Adventist Health System/Sunbelt Inc., doing business as Florida Hospital Rehabilitation & Sports Medicine Maitland. Because, the lawsuit claims, the defendants' employee failed to properly instruct and supervise the patient during her therapy and further failed to appreciate a fall risk, they should be liable for the plaintiff's bodily injuries and other damages.

In addition to physical pain and suffering, the wife's complaints include mental anguish, disfigurement and disability, as well as medical expenses incurred as a result. The husband's legal complaints include a loss of companionship and consortium. The couple is seeking a judgment of over $15,000, in addition to all legal fees and any further relief as the court sees fit.
