Woman's eyes permanently burned, alleges medical malpractice suit

Imagine undergoing surgery only to awaken in a worse physical condition than before. In a case that blurs the lines between product liability and medical malpractice, a couple has recently filed a lawsuit alleging that the wife suffered injuries during an eye surgery due to the equipment used. While the surgery didn't occur in Washington, D.C., the scenario is one that could easily have happened in an operating room anywhere in the country.

The plaintiffs, a husband and wife, recently filed a complaint against Bausch + Lomb, Bausch + Lomb Surgical Inc. and Valeant Pharmaceuticals International Inc. Per the lawsuit, in 2015 the woman underwent a surgery for cataract extraction with posterior lens implant. During the procedure, the physician used the defendants' equipment, the Stellaris PC and Stellaris Handpiece.

The complaint alleges that, during the surgical procedure, the woman suffered severe and permanent burns to her cornea. She seeks to hold the defendants liable for their alleged failure to properly tested their products to insure they would not harm patients. For this alleged negligence, the injured woman and her husband are requesting judgments in excess of $150,000.

The plaintiffs have asked for a trial by jury, undoubtedly seeking some form of justice for the woman's pain and suffering, in addition to any monetary damagesthat may be awarded. In cases like this or other instances of surgical error in Washington, D.C., the support and counsel of a medical malpractice attorney often proves invaluable. Successfully litigated malpractice cases are sometimes the only way of obtaining the funds necessary to pay for the follow-up care and ongoing treatment that victims of medical negligence may need.
