Negligent delivery leaves infant with permanent brain damage

Instances of professional medical error are bad enough when they happen to adults, but there is little worse for most parents than when their children are the victims. For many Washington, D.C., residents, the birth of their babies is a joyous occasion, but in cases where a negligent delivery leaves a baby with birth injuries, what should have been the happiest day in many parents' lives becomes a lifelong battle for their children's health. Just such a devastating occurrence allegedly happened in another state and resulted in a long legal battle that ended in a settlement.

The plaintiffs recently received a settlement in their medical malpractice lawsuit totaling $15 million for the brain damage their child allegedly suffered during birth. The complaint alleges that the child's mother was given Pitocin during labor, but that hospital staff administered too high a dose. This overdose, in turn, led to contractions that were too strong and too close together.

According to the complaint, the excessive contractions restricted blood flow and oxygen to the baby's brain during delivery. Despite the warning signs of fetal distress, however, the hospital allegedly failed to perform a cesarean section in a timely manner. This, alleged the lawsuit, resulted in the cerebral palsy that has left the now 6-year-old girl unable to walk, talk or care for herself.

The child's severe brain damage from the alleged negligent delivery will require extensive ongoing medical treatment and therapy. The settlement the family received will hopefully help to mitigate some of the exorbitant medical expenses they will face for the rest of her life.
