Product liability suit alleges toxic materials in school lunch

For many residents of Washington, D.C., it sounds like a nightmare: Sending a child to school only to get a call later from the hospital that he or she has been poisoned. In another state though, a product liability suit has been filed after just such a scenario allegedly occurred. A middle school student apparently suffered serious injuries after ingesting a cleaning solution contained in the school lunch she was served.

The student is a minor and as such the suit was filed by her guardian ad litem. The complaint names as defendant Producer's Dairy Foods Inc. as well as Does 1 through 25 in case later responsible parties become apparent. Among other counts, the lawsuit alleges negligence and strict product liability.

The complaint states that the girl received her school-provided lunch and, as part of it, an orange juice produced by the defendant. Immediately after drinking the beverage, the girl's throat began burning and she started vomiting uncontrollably. She was rushed to a children's hospital where she was treated for ingestion of the toxic cleaning solution that was apparently present in her orange juice, according to the suit.

The lawsuit accuses the defendants of failing to properly monitor, supervise and train employees in the product preparation, thus failing to ensure compliance with performance standards and health regulations. The plaintiff is seeking general damages in a trial by jury and hopes to receive costs, interest and any further relief as the court sees fit. Any monetary awards will likely be used toward such expenses as costs for the girl's necessary medical treatments, among other expenses. Anyone in Washington, D.C., who has similarly suffered from exposure to toxic or hazardous materials in a dangerous product has the same legal right to explore his or her own options for justice and compensation with a product liability lawyer.
