Premises liability suit after young girl falls at Mall of America

Washington, D.C., businesses have a responsibility to provide a safe environment, free from hazards that could cause injury to anyone visiting the premises. When they fail to do so and someone is hurt as a result, they open themselves up to the possibility of a premises liability suit, and deservedly so. A good example of such an instance is a recent case involving a young girl's fall at the Mall of America.

The then 10-year-old was at a food court at the Mall of America when she slipped in a clear liquid, and she was not the only person to fall, either. Surveillance camera recordings show another woman falling approximately four minutes after the girl's slip. While a mop was brought out and a warning sign put up after the second fall, the sign was apparently positioned several feet from the hazardous location. Minutes after that, a little boy fell at the same spot as well.

According to court documents, medical teams employed by the Mall initially treated the girl for the sprained knee she suffered. However, she was on crutches for several months afterwards and has since been unable to participate in the sports she used to play. In fact, recent consultations with doctors indicate the possibility of lasting problems and complications from the injury.

Despite all this, the Mall of America denies any wrongdoing and refuses to pay for any of the girl's injuries. A jury trial regarding the incident is currently scheduled to take place in Sept. 2017. Any residents of Washington, D.C., who have similarly been injured due to negligent maintenance or hazardous conditions may benefit from exploring their rights with a premises liability lawyer, as a successfully presented case may result in an award of damages that can be used for expenses, such as medical treatments and pain and suffering.
