Premises liability lawsuit blames table canopy for head injury

Property owners in Washington, D.C. have an obligation to keep their buildings or business areas safe for visitors. A woman in one state claims she was hurt while visiting a home market and has since filed a premises liability lawsuit.

The woman visited an outdoor dining area where she says she suffered series head injuries due to an unsafe picnic table canopy. The lawsuit asserts that, while on the defendant's premises, she suffered head injuries that are both serious and permanent when she attempted to sit down at one of the tables. Specifically, she alleges that her head hit a concealed steel rod in one of the low-hanging canopies.

Allegedly, the height of the picnic table canopies and the steel rods within them created dangerous conditions that directly contributed to the woman's injuries. The woman is suing the Magnolia Market at the Silos, a popular tourist destination in Texas where the incident occurred, for up to $200,000 in damages due to her injuries. The amount is to cover past and future physical and mental impairment, physical pain and mental anguish and medical expenses.
