Washington, D.C. vapers beware: E-cigs might be dangerous product

The popularity of the vaping devices known as e-cigarettes is on the rise. These vaping devices, used in Washington, D.C. and nationwide, are touted as a safer, healthier alternative to smoking. However, it's hard to argue about a product's safety when the number of incidents involving explosions and fires caused by the apparently dangerous product is increasing. In fact, on Sept. 25, 2016, yet another product liability lawsuit was filed, this time against the shop that sold a device. It exploded, resulting in a man being seriously burned.

The plaintiff claims that the lithium-ion Efest battery in his vaping device – a Chinese Sigelei Spark Mod – caught fire while in his pocket. The device then exploded, causing substantial burns to the man's legs, groin and hands. For his injuries, and to help cover the cost of the lawsuit, the plaintiff is seeking a judgment in excess of $50,000.

The claim alleges that the shop failed to warn of the risk of explosion as well as any risks associated with charging the battery. It is also claimed that the shop was negligent in selling a product that failed to protect against overheating and subsequently caught fire and exploded. In addition, it is alleged that the shop was negligent in selling components that were not compatible because they were manufactured by different companies, often in foreign countries with insufficient quality control.

A 2014 study by Federal Emergency Management Agency and the U.S. Fire Administration showed 25 incidents of fires and explosions from vaping devices between 2009 and 2014 in the United States alone. Since then, these occurrences have only continued to rise, with an additional 42 incidents reported in 2015 and nearly double that in 2016.
