Suit claims hospital failure leads to infant brain damage, death

To expectant mothers in Washington, D.C. and around the world, almost nothing could be more important than the health and well-being of their unborn children. Because of this, women put their trust in obstetricians and hospitals to help keep their babies safe. When the health care professionals charged with this task fail to take this duty seriously, any resulting brain damage or health problems can be serious or even deadly.

Sadly, this is why two parents are suing Greenwich Hospital in Connecticut after the death of their infant daughter during labor and delivery. The lawsuit, filed Jan. 4, also names Dr. Marjan Hedayatzadeh and Obstetrics and Gynecology for Women by Women as defendants, is seeking over $15,000 in damages. The suit claims that the staff's failure to appropriately monitor and then promptly deliver the distressed infant resulted in her death.

When the mother was admitted to the hospital after her amniotic sac ruptured, medical staff allegedly documented that, at some point, they began having difficulty hearing the infants' heartbeats and were unable to maintain fetal heart tracing. Instead of obtaining an ultrasound to determine fetal distress or performing an emergency cesarean section, the staff failed to act. When the C-section was performed over three hours later, the baby had died from oxygen deprivation to the brain, known as anoxic brain death.

The state Department of Public Health investigated and found regulation violations related to the tragic incident. The hospital has since implemented new policies and procedures in response. This action, of course, does not change the outcome for the baby, but at least the suit is attempting to make sure the responsible parties are held accountable for their actions. If any grieving parent in Washington D.C. has a child who suffered brain damage or died as a result of a health care provider's negligence may benefit from seeking the counsel of an experienced medical malpractice attorney.
