Johnson & Johnson is now settling morcellator cases

In recent months, approximately 100 women and surviving family members brought claims against Johnson & Johnson, a major manufacturer of the power morcellator. For decades, surgeons used the power morcellator used in hysterectomies and myomectomies, which remove uterine fibroids. The morcellator works by grinding body tissue into tiny pieces. For women with undetected uterine cancer, or leiomyosarcoma, the morcellator would grind cancerous tissue and spread this cancer throughout the body. As a result, cancer that could have been treated was upstaged to Stage 4 cancer within a brief period of time.

Considering that According to the Food and Drug Administration (FDA), roughly 1 in 350 women who underwent morcellation suffered upstaged cancer as a result of the procedure. In November 2014, the FDA issued a "black box" warning, cautioning against the use of morcellators in hysterectomies and myomectomies.

Victims of morcellation and their families are now receiving six- and seven-figure settlements

In December 2015, dozens of families brought claims against Ethicon, a division of Johnson & Johnson, with dozens more claims added in early 2016. Families brought these claims in federal court in Kansas City, Kansas. In March, Johnson & Johnson began settling these cases. According to the Wall Street Journal, sources familiar with the litigation say that Johnson & Johnson is settling claims for anywhere between $100,000 and roughly $1,000,000. The settlement amounts are based on the woman's age, overall health, whether she had children, and other factors.

Many morcellator cases have settled and other cases are in the process of settling. With this said, women and families who have lost loved ones due to morcellation who have not yet brought a claim may still have the opportunity to recover compensation.
