Can you sue if skin cancer is misdiagnosed?

Having cancer or other diseases misdiagnosed can put you in a precarious position. If your disorder or disease worsens because of a misdiagnosis, you may be in a position to make a claim, since you could have treated it sooner. Sometimes, people don't think they can claim when a doctor misdiagnoses them, but that's not always the case.

Can you sue for a misdiagnosis of skin cancer?

Any time a misdiagnosis is made, you have a legitimate claim for medical malpractice. Skin cancer can be just as deadly as other kinds, and it's important that you're diagnosed correctly. However, it can be hard to prove that the malpractice took place, so it's important to take steps to confirm it with evidence.

How do you prove medical malpractice?

The first thing you need to prove is that the doctor owed you a duty of care. If he or she did and breached that duty, failing to provide you with the care you needed, then you can say that he or she did deviate from the standard of care he or she should have provided.
