What is an erroneous diagnosis or failed treatment?

If a doctor fails to diagnose a condition or gives the wrong diagnosis, that error can put a person's life at risk or cause him or her injuries. In most cases, when you're left to suffer from a disease or when you lose a loved one due to misdiagnoses or a failure to diagnose, you can look into the case and see if negligence or malpractice took place. Your attorney can then help you file a claim to get compensation. If another doctor would have made the diagnosis in enough time to prevent the injuries or death, it's likely that you can hold your medical provider liable.

The failure to treat a disease or condition is also a concern. If a medical provider doesn't recognize a condition like diabetes, for instance, the person suffering from it could suffer seizures, organ failure, or other serious problems. The harm caused to the patient in that case could be life-threatening or disabling, and the doctor could be held liable for failing to treat the disease as necessary.

If a doctor dismisses a patient's condition or treats it inappropriately, that puts the patient at risk, so the medical provider needs to be held accountable for those mistakes.

Erroneous treatments may also take place. For instance, if a patient is suffering from allergies and a doctor tries a holistic remedy in place of a traditional treatment like allergy medications, the patient could suffer a serious allergic reaction or even anaphylaxis. In that case, the treatment was inappropriate and the provider could be held liable for the patient's injuries.
