What are some common medical malpractice concerns?

If you've been hurt by a medical team or neglected by your doctor, you may be thinking of making a medical malpractice claim with the help of your attorney. Before you do so, you should have the answers to a few commonly asked questions.

First, if you think you have a claim, discuss it with your attorney before you decide to move forward with it. Your attorney can talk to you about the situation and advise you on the possibilities of the case. On top of that, your attorney knows the length of time you have to make your case, so you can be sure to file early enough to avoid the statute of limitations.

Your attorney may ask you about informed consent and if you were told about the risks of your procedure. Sometimes, doctors or surgeons may make a procedure seem safer than it is. This could be because they feel it's necessary for the patient or because they want to earn compensation from the procedure. In any case, it's important that you are fully informed before any medical procedure. If you weren't told about the risks, it's possible you could have a case against the medical provider.

Something else you may have run into is the use of experimental drugs in your care. Sometimes, new drugs are on the market and need people to test them. If you're willing to do so, it could be beneficial, but there's also a risk of the drug not working. Your doctor needs to inform you that your treatment involves experimental drugs or procedures before you use them or have a procedure performed.
