A Petition For Change

The power morcellator is a medical device commonly used in hysterectomies. This device cuts body tissue into tiny pieces, allowing for its easy removal from the body cavity. Most women undergo hysterectomies for uterine fibroids. For women who have a type of uterine cancer, or leiomyosarcoma (LMS), the use of a power morcellator is devastating. In fact, the use of the power morcellator in hysterectomies has needlessly caused many deaths. When cancer cells are morcellated, they will spread throughout the abdomen. Consequently, what was once a treatable stage 1 cancer can turn into a stage 4 cancer in a matter of weeks or months. The Food and Drug Administration (FDA) has been aware for years that 1 in 350 women who have surgery to remove uterine fibroids actually have LMS.

Raising Awareness And Taking Action

Many individuals have stepped forward to make others aware of these needless tragedies. Amy Reed, M.D., Ph.D, and her husband, Hooman Noorchashm, M.D., Ph.D., are at the forefront of this effort. In October 2013, Dr. Reed underwent power morcellation to remove uterine fibroids. Tragically, this procedure caused previously undiagnosed cancer to spread throughout her abdomen.

Dr. Reed and Dr. Noorchashm have taken many steps to end the use of power morcellators in gynecological surgery. One such step is their creation of a Change.org petition. This petition asks that the American College of Obstetricians and Gynecologists and the American Board of Obstetrics and Gynecology change its standard of care and end the use of morcellators in hysterectomies.

This petition, which was sent to President Obama, the Commissioner of the FDA, and many others, also highlights the risks associated with power morcellation and how it can upstage uterine cancers. For instance:

  • Only 15%, or roughly 1 in 7, women survive stage 4 leiomyosarcoma (LMS) for more than five years.
  • On average, women with morcellated sarcoma only live between 24-36 months
  • Women whose sarcoma has been morcellated are more than four times likely to die from sarcoma than those women whose sarcoma has not been morcellated.

To date, nearly 90,000 individuals have signed this petition.

If you or someone you love has LMS, and it has been upstaged due to morcellation, you may have the right to recover compensation. The lawyers of Fay Law Group, P.A. have a history of success fighting for individuals and families who have sustained fatal or catastrophic harm due to another's negligent or reckless actions.
