Woman practicing midwifery without certification guilty

If you gave birth to a child at home who then passed away or if you were injured badly while giving birth, then you may understand what the mother in this case is going through. After a failed home birth, her midwife has now pleaded guilty to the murder of an unborn child among other charges. If your home birth goes wrong, is your midwife to blame? In this case and for this woman, she may have been.

According to the story, the birth took place in 2012. The 46-year-old midwife was charged with the murder of an unborn child, obtaining property by false pretense, obstruction of justice and assault inflicting serious bodily injury. How did that happen, though, at a time when she should have been welcoming new life into the world?

According to North Carolina law, and in Washington, D.C., as well, midwives need to be certified. That means they need to have gone through registered courses to learn how to manage the birthing process and ways to handle the situation if it goes wrong. The story points out that the 46-year-old woman did not obtain a certification from an accredited midwifery education program or pass her national certification exam.

The woman was ordered to serve up to 17 months in prison, but the sentence was suspended since the family who hired her knew she was not certified. She has also been ordered not to practice midwifery, but the story shows how you can never be too careful when you're checking for the proper certifications for your medical care team.

When injuries or death occur because of medical negligence, the victim or his or her family have a right to seek compensation. These can be complex cases, so the guidance and advice of an experienced medical malpractice attorney is recommended.
