What should I do if I'm a victim of medical malpractice?

There are several steps you should take if you feel that your medical professional didn't treat you in accordance with the accepted standard of care.

Should I let the doctor or medical professional know my concerns?

You should contact the medical professional about your concerns for a couple of reasons. First, you might be able to find out if the problem can be corrected. Second, you might be able to understand why the negligence occurred. Ideally, you should talk to the medical professional before you file a claim.

Is there anything else I can do?

You can contact the medical licensing board with whom the medical professional is licensed. While this won't get you compensation, the board can take disciplinary actions and issue warnings about the situation. You can also opt to file a lawsuit, but you should first have a medical assessment.

What is a medical assessment?

A medical assessment occurs when an expert reviews your medical record to determine if your case has merit. During the assessment, the expert will decide if the medical professional acted in a negligent manner that would cause your injuries.

In some cases, you might decide to file a medical malpractice lawsuit. It is vital that you learn about the statute of limitations, applicable laws and the procedures for seeking compensation for your claims through the civil court system.
