What is premises liability and why does it matter?

Property hazards can cause people to suffer severe injuries and even death. That is why the law helps to ensure that victims may hold property owners liable for harm caused under the theory of premises liability. This area of law is complex. As a result, not every injury sustained as a result of a property hazard is eligible for compensation under the law. However, if you have been injured while on another's property, chances are that you may have a legitimate premises liability claim.

One common kind of premises liability case involves slip and fall injuries. If a property owner fails to remove ice, snow or wet leaves within a certain timeframe, individuals injured by falling on these substances can usually hold the property owner accountable. This kind of legal protection against slippery substances and tripping hazards also applies to slip and fall injuries that occur in stores, places of business and parking lots.

Other common kinds of premises liability claims involve defective designs of buildings, elevators, escalators and other structures. Falling objects, wall collapses and poor lighting can lead to injuries in these kinds of claims. Individuals harmed in building fires, in assaults that occur on property that is not properly secured and in generally unsafe conditions also may have legitimate premises liability claims.

Though the media may not cover premises liability stories as frequently as motor vehicle accidents, medical malpractice cases and criminal law issues, it is no less important as an area of law generally. Premises liability allows individuals the security of knowing that the properties they visit will not cause them harm. It also helps to ensure that victims of negligent and hazardous property conditions are compensated for the harm they have suffered.
