What are the first steps to filing a medical malpractice case?

When you're interested in filing a medical malpractice lawsuit in Washington, D.C., you need to understand what the steps are to do so. A lawsuit is typically only sought by patients who have been injured due to neglect or dangerous medical treatment. Sometimes, lawsuits can represent those who have had an incorrect diagnose significantly impact their lives.

Lawsuits can be filed against doctors, nurses, technicians, medical workers or hospitals as a whole. Sometimes, cases file against multiple parties, because all of them should be checking the work and backgrounds of employees.

Is your case one where medical malpractice took place? You need to find out if what happened to you would have happened no matter who did the procedure or prescribed treatment. If you would have had a similar outcome regardless, you may not have a case. However, if you were injured and it's obvious that mistakes were made, then medical malpractice is probably at play.

Before you file a claim with the courts, talk to your doctor. He or she may be able to come to a solution with you that helps you get the care you need or be able to explain what happened to cause your condition. You will also want to contact the medical licensing board if speaking with your care provider doesn't help the situation. The medical board is responsible for warnings and disciplinary action against medical professionals.

If you still want to proceed with a case, it's important that you get a medical assessment by a third party. This medical assessment can confirm your case and if it is strong enough to head to court.
